1. Agreement to Terms

By accessing or using Gambit (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must be legally able to form a contract to use the Service. You are responsible for all activity under your account and for keeping credentials secure. You agree to provide accurate, current information and keep it updated.

3. Acceptable Use

You agree not to misuse the Service or attempt to access it without authorization, reverse engineer it, or interfere with its normal operation. You will use the Service only in compliance with applicable laws and regulations.

4. Your Content and Data

You retain ownership of your content and data. You grant Gambit a limited license to process, host, and display your content solely to provide the Service, including syncing calendars and generating views.

You are responsible for the legality, accuracy, and integrity of the content you provide and any actions taken based on it.

5. Third-Party Services

The Service may integrate with third-party services (e.g., Google Calendar). Gambit does not control those services and is not responsible for their availability, content, or practices.

6. Service Availability

We strive to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages, or changes may occur without notice.

7. Termination

You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe the Terms have been violated or if required to comply with law.

8. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Gambit and its affiliates, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or business, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, Gambit’s total liability for any claim arising out of or relating to the Service will not exceed the amount paid by you to Gambit in the twelve (12) months preceding the event giving rise to the claim (or $100 if no fees were paid).

10. Indemnification

You agree to indemnify and hold harmless Gambit and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. If changes are material, we will provide notice by posting the updated Terms. Continued use of the Service constitutes acceptance.
